Terms and Conditions
North Kent Weddings Photography –
Wedding and Civil Ceremony Terms (JAN
2008)
Please read the following terms and conditions carefully. You will
be asked to sign a paper copy and return with your deposit and your
booking is conditional on accepting these terms.
• BOOKING FEE: A deposit of £50.00
is required. Dates will be reserved only when this deposit is paid
by cash, cheque, credit or debit card (2% surcharge for credit cards).
This deposit is non-refundable. Please make cheques payable to North
Kent Weddings. A full unconditional refund policy exists for a period
of 14 days from receipt of the contract and payment. After that
date, refunds are at the discretion of North Kent Weddings. Payment
of a deposit in an indication of accepting these terms.
• BOOKING FORM: Upon agreement in principle
to photograph a wedding or other event, the photographer will meet
the clients if requested and request a booking form be signed and
the deposit paid to reserve a date for the photography. A date is
not reserved until the booking form and a signed terms and conditions
form is with the photographers, who will confirm the booking in
writing within 7 days. This forms a legally binding contract.
• PAYMENTS: The balance of payment for the
photography will be invoiced one month prior to the wedding and
must be settled in full 2 weeks before the wedding day, by either
cash cheque, credit or debit card (2% surcharge for credit cards).
Any bank charges incurred due to returned cheques will be charged
to the client. In the event of either the deposit or balance not
clearing in a UK bank any dates reserved will become available to
other wedding parties with immediate effect.
• REQUESTED PHOTOGRAPHS:
The photographer will honour all photographs requested and agreed
in advance, provided the following factors are met: Weather and
allocated time permitting, availability and co-operation of the
person/s concerned.
• COVERAGE: The Photographer cannot be held
responsible for the lack of coverage caused by: the bride, the groom
or wedding party not being on time, the Church, Register Office,
or licensed place of wedding having restrictions regarding photography.
The Photographer does not undertake to guarantee any specific picture
nor incorporate any specific background, location or group arrangement.
• WEATHER & ILLNESS:
North Kent Weddings cannot be held responsible for images and photography
sessions being disrupted by adverse/unfavourable weather conditions.
North Kent Weddings Photography shall not be liable for any amount
in excess of the retail value of your package. North Kent Weddings
Photography may substitute photographers to take photographs at
your wedding in the event of photographer’s illness. All re-orders
shall be considered an extension of this contract. All re-orders
must be paid for in full prior to orders being dispatched.
• EXCLUSIVITY: North Kent Weddings Photography
shall be the exclusive photographer retained by the client. Family
and friends are permitted to take photographs as long as they do
not disturb, disrupt or interfere with photographer’s duties.
The photographer has the right to kindly ask the person obstructing
to refrain from doing so, in order for North Kent Weddings Photography
to carry on their duties. North Kent Weddings Photography reserves
the right to use your images for any form of advertising to promote
our company.
• PHOTOGRAPHS – The Photographers will
seek to provide a pleasing colour balance but cannot guarantee exact
colour matching. Owing to anomalous reflectance caused by a combination
of certain dyes and materials it is often impossible to record on
film the exact colours seen by the human eye. Digital retouching,
enhancement, and finishing are available at extra cost.
• COPYRIGHT: The Copyright of all the photographs
produced is retained by North Kent Weddings Photography and it is
a criminal offence to make copies from them by any means including
video under the terms of the COPYRIGHT, DESIGNS and PATENTS ACTS
1988
• Every care is taken in photographing and processing using
professional methods. In the unlikely event of total photographic
failure i.e. during exposure or processing, the Photographer's liability
shall be limited to a full refund of all monies paid. Your statutory
rights are not affected.
